Petitioner Bernardo Ontiveros-Lopez seeks review of three decisions of the Board of Immigration Appeals ("BIA"). Ontiveros-Lopez alleges that he was denied due process of law because of ineffective assistance of counsel at his deportation hearing. Despite Ontiveros-Lopezs asserted innocence, counsel did not dispute deportability. Instead, his attorney sought relief from deportation based on Ontiveros-Lopezs wifes status as a United States citizen. In fact, counsel misread the law, and relief was statutorily unavailable to Ontiveros-Lopez on this basis.
